Why Two Apartments in Madrid Can Look Identical but Have Completely Different Paperwork

Most people assume that if two flats look the same, in the same building, same layout… the paperwork must be identical.

In Madrid, that’s rarely true.

Recently, I reviewed two different apartments in the same building in Chamberí for a client. Both were spacious family flats — around 150–160 m², same layout, same floor plan, same building. To the eye, they were almost identical.

But the paperwork? Completely different stories.

  1. Catastro vs Escritura differed by more than 15 m²

One apartment showed 162 m² in the Catastro but only 147 m² in the Escritura. The other showed the opposite. Two similar flats, two very different legal realities.

This is extremely common in Madrid, especially in larger properties that have gone through multiple renovations or ownership changes.

  1. One had a major renovation that was never registered

A beautiful integrated kitchen + dining area… but no record of a building permit at the Ayuntamiento.

If the city inspects, the buyer becomes responsible — not the seller. Many foreign buyers don’t realise this until it’s too late.

  1. Community rules were not the same

One unit had written permission for short‑term rentals from years ago. The other didn’t.

Same staircase, same neighbours, same building — completely different rights.

  1. One apartment carried an old community debt

A previous owner hadn’t paid several months of community fees. That debt legally passes to the new buyer.

This is one of the most common (and most expensive) surprises for foreigners buying in Madrid.
